Probate Home Sales in Yuba County, California

If you are an executor or successor trustee with a house in Yuba County, start with two local facts. Probate runs through the Civil Division of Yuba County Superior Court, 215 Fifth Street, Suite 200, Marysville, CA 95901, phone (530) 740-1800. And electronic filing is mandatory here for probate cases, and has been since July 1, 2018. Bart Hubbard sells probate and trust homes throughout the county. Source: Yuba probate division.

Yuba County sits where the Feather and Yuba rivers meet, with levee roads, orchard ground and rice land on the valley floor and the Sierra foothills climbing east. Marysville’s older core holds a lot of Victorian and early twentieth century housing stock, some beautifully kept and some carrying a century of additions. South and west of the city the housing is newer and flatter.

That split matters when you price an estate property. An older Marysville home may need a sewer scope, a foundation look and an honest conversation about the wiring before anyone talks list price. Foothill properties east of the valley bring their own questions: well, septic, access road and fire insurance.

Where is probate filed in Yuba County?

At 215 Fifth Street, Suite 200, in Marysville, through the court’s Civil Division rather than a standalone probate department. Probate is filed where the person lived at death, so a home in Linda, Olivehurst, Plumas Lake or Browns Valley is a Yuba County case. Because e-filing is mandatory, your attorney files online, not at a counter.

How do Yuba County probate notes work?

Probate notes are court staff’s written evaluation of a pending matter, and Yuba is unusually clear about what they mean. They are recommendations, not tentative rulings. If the notes recommend granting your petition, you do not have to appear. If your case is not mentioned at all, you do. Read them every time, because an assumption in either direction costs a hearing date.

Do you need court confirmation to sell the house?

Not if the letters grant full authority. Letters are the court document proving the personal representative, the executor or administrator in charge, can act for the estate. Full authority under the Independent Administration of Estates Act, or IAEA, removes the confirmation requirements, including publication and the 90% floor. Prob. Code 10503. Limited authority does not cover selling real property. Prob. Code 10501(b).

What is a Notice of Proposed Action?

It is the notice a representative with full authority sends before selling, and it replaces the confirmation hearing. It goes to each known heir or devisee whose interest is affected and to anyone who requested special notice, delivered not less than 15 days before the action may be taken. Prob. Code 10586. For a real property sale it must state the material terms, including price and commission. A timely objection sends the sale back to court supervision.

What is the house worth as of the date of death?

A probate referee appointed by the State Controller sets the date-of-death value for the inventory and appraisal, due within four months after letters issue under Prob. Code 8800(b). The referee’s fee is one-tenth of one percent of the value appraised, with a $75 floor and a $10,000 ceiling. Source: State Controller’s probate referee page. That figure also sets the heirs’ stepped-up tax basis under IRC 1014(a).

Where do you record the deed and file a Prop 19 claim?

Both offices sit at 915 8th Street in Marysville, which saves a trip. The Clerk-Recorder is in Suite 107, and the county publishes a deed recording checklist covering grantor and grantee names, the property description, the transfer tax declaration, the notary acknowledgment, the change of ownership report and the parcel number. The Assessor takes the BOE-19-P claim if a child keeps the home as a principal residence.
