Selling a Probate or Inherited Home in Amador County

Amador County is the smallest county Bart Hubbard serves, and small changes how probate feels. Probate is filed and heard at the Amador Superior Court, 500 Argonaut Lane, Jackson, CA 95642, with public access 8:00 a.m. to 3:00 p.m. on weekdays. There is no direct probate phone line: calls route through the civil and probate filing line, 209-257-2603, or the general number, 209-257-2600. Update your bookmarks too: the court’s old domain, amadorcourt.org, now redirects to amador.courts.ca.gov. Sources: Amador probate division and court contact information.

The county runs from the valley edge near Ione up through Jackson, Sutter Creek and Pine Grove toward the Sierra, with oak grazing land and Shenandoah Valley vineyards giving way to pine country as the elevation rises. County population is 39,618, and estate property takes very different shapes: Gold Rush era homes in the old town cores, farmhouse and ranch parcels on acreage, and cabins at Pioneer and Mace Meadows.

So valuation here is rarely simple. An 1800s Sutter Creek house, a five-acre parcel with a well and septic system in the Shenandoah Valley, and a 1990s home out toward Camanche are three different sales. Comparable sales run thin, so expect a wider radius, a longer lookback and an honest range rather than one number.

Where is probate filed in Amador County?

At 500 Argonaut Lane in Jackson, the county seat. Probate is filed where the person lived at death, so a home in Ione, Sutter Creek, Plymouth, Pine Grove or Volcano belongs to this court. Building access ends at 3:00 p.m., earlier than most courthouses nearby, so a late afternoon counter trip will not work.

Why does it matter that the local rules barely mention estates?

Because it tells you where to look for answers. Amador’s probate chapter covers accountings, successor fiduciaries, investigator fees and capacity declarations in guardianships and conservatorships. Rule 1.07 points probate filings to the civil law and motion rules. So an executor’s procedure comes from the Probate Code, the statewide Rules of Court and local civil practice.

Can you check examiner notes before the hearing?

Not on the court’s website. Nothing resembling probate notes or tentative rulings appears on the probate, contact or online services pages. In counties that publish notes, you get early warning of defects. Here you do not, so the petition needs to be right the first time.

Does the executor need court confirmation to sell?

It depends on the letters. The personal representative is the executor or administrator the court appoints, and the letters state whether they hold full or limited authority under the Independent Administration of Estates Act, or IAEA. Full authority switches off the confirmation rules, including publication, the 90% minimum and the overbid. Prob. Code 10503. Limited authority does not reach real property. Prob. Code 10501(b).

What does the 90% rule mean for a rural property?

In a court-confirmed private sale, the offer must be at least 90% of the appraised value, on an appraisal less than a year old at the hearing. Prob. Code 10309. Source: Justia. On acreage and older foothill homes, an appraisal set early can drift from the market before an offer arrives. Watch that one-year window.

Where do you record the deed and handle property taxes?

Both offices sit at 810 Court Street in Jackson, open 8:00 a.m. to 4:00 p.m. weekdays. Bring cash or a check, because cards are not accepted. If a child keeps the family home and wants the Proposition 19 parent-child exclusion, the claim form is BOE-19-P, due within three years of the transfer or before the home passes to a third party. Does Bart list homes in Amador County?

Yes. Amador sits at the outer edge of the service area, roughly 60 miles from downtown Sacramento, and Bart travels out for appointments, walkthroughs and signings rather than working the county from a desk. The service areas page shows the whole territory. For a seller who would rather have an agent minutes from the property, he can introduce a partner agent.

What should you do first?

  1. Check how the property is held. A revocable trust usually keeps the house out of court, and a successor trustee can sell under Prob. Code 16226.
  2. If probate is needed, hire a California probate attorney and file the petition. The first hearing is set 15 to 30 days out.
  3. Protect a vacant house. California’s standard fire policy suspends coverage past 60 consecutive vacant days under Ins. Code 2071, and rural parcels need defensible space kept up.
  4. Arrange the probate referee’s date-of-death appraisal. The inventory is due within four months after letters issue under Prob. Code 8800(b).
  5. Get a written market valuation built on a wide enough comparable set for a thin rural market.
