Bart Hubbard helps families sell inherited, probate and trust homes in Sutter County, where everything court-related happens in one building. Probate is filed and heard at the Sutter County Superior Courthouse, 1175 Civic Center Blvd, Yuba City, CA 95993, open weekdays 8:30 a.m. to 4:30 p.m., with probate sharing the civil line at 530-822-3304. Sutter is a small, flat, agricultural county built around the Feather River and the Sutter Buttes, with orchard and row-crop land running in most directions from Yuba City. It has two incorporated cities, Yuba City and Live Oak, plus rural communities along the levee roads. Most estate properties are single-story homes on generous lots, later tract housing, older farmhouses and small acreage parcels.
Acreage is where Sutter estates get interesting. A parcel with an orchard, a well, a septic system or outbuildings is not priced like a subdivision home. If the estate includes land as well as a house, say so early. It changes the buyer pool and the escrow timeline.

Where is probate filed in Sutter County?
At the Yuba City courthouse on Civic Center Blvd, which handles every case type the county hears. Probate is filed where the person lived, so a home in Live Oak or out toward Meridian belongs here even if the family now lives elsewhere. Call 530-822-3304 before making a trip.
What does it mean that Sutter has no local probate rules?
It means fewer county-specific traps and fewer county-specific shortcuts. Practice runs on the California Probate Code and the statewide California Rules of Court. For an executor that is mostly good news: the petition, the notices and the accounting look the way the statewide forms say they should. It also means no local rule to look up when a procedural question comes along.
Can you read examiner notes before the hearing?
Not online. The court’s probate, civil and general information pages post no probate notes or probate tentative rulings. In counties that publish them, examiner notes tell you in advance what the court wants fixed. Without that, arrive prepared and build slack into any closing date tied to a hearing.
Does the sale need court confirmation?
Only if the personal representative lacks full authority. A personal representative is the executor or administrator the court appoints, and the letters say whether they hold full or limited authority under the Independent Administration of Estates Act, or IAEA. Full authority skips confirmation, publication and the overbid under Prob. Code 10503. Limited authority does not reach real estate, so the sale goes back to the judge under Prob. Code 10501(b).
What happens at a court confirmation hearing?
The sale is reported to the court and confirmed before title passes. The accepted offer must be at least 90% of the appraised value, on an appraisal no more than a year old, under Prob. Code 10309. Anyone present can overbid. The first overbid must add at least 10% of the first $10,000 plus 5% of the rest, so a $500,000 bid needs $525,500 to top it. Prob. Code 10311. Source: Justia.
Where do you record the deed, and what about Prop 19?
Recording happens at the Clerk-Recorder at 433 Second Street, not at the Assessor’s office on Civic Center Blvd. Get there before 2:00 p.m., and note the office closes at 2:00 p.m. entirely on the first Wednesday of the month. A child keeping the family home claims the Proposition 19 parent-child exclusion from the Assessor on form BOE-19-P, which covers the factored base-year value plus $1,044,586 through February 15, 2027. Does Bart sell homes in Sutter County?
Yes. Sutter sits at the northern edge of the service area, roughly 60 miles from downtown Sacramento, and Bart travels up for listing appointments, walkthroughs and signings rather than working the county from a desk. See the service areas page. For a seller who would rather have an agent minutes from the property, he can introduce a partner agent.
Cities and communities served
- Yuba City, population 71,572
- Live Oak, population 9,755
- Unincorporated rural communities including Meridian, Nicolaus, East Nicolaus, Rio Oso, Robbins, Sutter and Trowbridge
Populations are California Department of Finance estimates as of January 1, 2026.
What should you do first?
- Confirm how the house is titled. A house already in a revocable trust usually avoids probate, and a successor trustee can sell without a judge under Prob. Code 16226.
- Hire a California probate attorney if the house must go through probate, and get the petition filed.
- Protect the property. California’s standard fire policy suspends coverage once a building sits vacant beyond 60 consecutive days, under Ins. Code 2071.
- Ask the probate referee for the date-of-death appraisal early, since the inventory is due within four months of letters.
- Get a current market valuation, especially if land, outbuildings or an older roof are involved, then choose between preparing the house and selling it as it sits.
